Our Privacy Notice

Lean Agile Intelligence, Inc. (“Lean Agile Intelligence,” “we,” or “us”) respects your privacy and is committed to protecting your privacy when you use or visit the Lean Agile Intelligence website at LeanAgileIntelligence.com (the “Website”). This privacy notice (our “Privacy Notice” or “Notice”) describes:

  • The types of information we may collect from you or that you may provide us; and
  • Our practices for collecting, using, maintaining, protecting, and disclosing that information.

This Notice applies only to information we collect through the Website and in email or other electronic communications sent through or in connection with the Website. This Privacy Notice DOES NOT apply to information that:

  • We collect offline or through any other means, including from any other website or social media or other platform operated by Lean Agile Intelligence or any third party; or
  • You provide to or is collected by any third party, including through any application or content that may link to or be accessible from or on the Website. These third parties may have their own privacy policies, which we encourage you to read before providing information on or through them, and we accept no responsibility or liability for any third party.
Changes to Privacy Notice

This Notice may change from time to time, and you are responsible for checking this Privacy Notice periodically for updates when accessing or using the Website. The date the Privacy Notice was last revised is identified at the top of the page. If we make material changes to how we treat your personal information, we will notify you through a notice on the Website home page. Your continued use of the Website after we make changes to this Privacy Notice is deemed to be your acceptance of those changes.

Information We Collect and How We Collect It

At any given time, we may collect several types of information from and about users of our Website, including information:

  • By which you may be personally identified, such as your name, IP and/or physical address, email address, phone number, or any other identifier that can be used on its own or with other information to identify, contact or locate you (“personal information”);
  • That is about you but individually does not identify you; and
  • About your internet connection, the equipment you use to access our Website and other usage details.

We may collect this information:

  • Directly from you when you provide it to us;
  • Automatically when you access or use the Website; and/or
  • From third parties, such as vendors or business partners.
Information You Provide to Us

The information we collect on or through our Website may include:

  • Information that you provide by filling in forms on our Website or contacting us via email, including, but not limited to, information you provide at the time you create an account, sign up for or subscribe to communications from Lean Agile Intelligence, post any materials, submit or support user reviews, and/or at the time you contact us;
  • Records and copies of your correspondence with us;
  • Your responses to forms, surveys, or questions that we might pose or ask you to complete; and
  • Details of any transactions you may carry out through third-party or other payments systems available on or through our Website, including order fulfillment and customer service information.

The Website may also allow you to provide, post, submit, publish, display, or transmit to other users, other persons, or post publicly, information, content, or materials (each a “User Contribution”). Your User Contributions are posted on the Website and transmitted to others at your own risk. Although we may monitor certain pages, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Website with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons. User Contributions may include user reviews and user feedback about products or services. As stated in the Terms of Use, you grant Lean Agile Intelligence the perpetual and irrevocable right to delete, or copy, modify, adapt, publish, or otherwise use all or part of any review or feedback you submit on or through the Website throughout the world, without notice, attribution, or payment to you.

Automatic Information Collection and Tracking

When you access and use the Website, we may use technology to automatically collect information, which may include:

  • Location data;
  • Length of time you visit our Website;
  • Page views, click-stream information, and referring URL and logs;
  • The resources and devices that you access and use on or through the Website; and/or
  • Information about your device and internet connection, such as the device’s unique device identifier, IP address, operating system, browser type, and network information.
  • The Website also may access metadata and other information associated with other files stored on your device.
  • Information that we may collect through automatic technological means may be: aggregated as statistical data; include personal information; and/or be maintained or associated with information we collect in other ways or receive from third parties.
Technologies Used for Information Collection and Tracking

We may use one or more technologies to accomplish automatic information collection on or through our Website, examples of which are found below.

  • Essential Cookies. Essential cookies are necessary to the core functionality of our Website and some of its features, such as access to secure areas.
  • Performance/Analytical Cookies. Performance/Analytical cookies allow us to understand how visitors use our Website such as collecting information about the number of visitors to our Website, what pages visitors view, and how long visitors are viewing pages. Information about your browser, device, and IP address may be collected.
  • Web Beacons and Other Technologies. Pages of our Website and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us to count users who have visited those pages or opened an email and for other related Website statistics (for example, recording the popularity of certain Website content and verifying system and server integrity). The information we may obtain in this manner would enable us to customize the Website and to measure the overall effectiveness of the Website.
  • Google. Google Analytics is a web analytics service provided by Google Inc. It uses cookies to collect, for example, information about the operating system and the browser that you use, your IP address, the Website you previously accessed (referrer URL) and the date and time of your visit to the Website. On subsequent repeated visits to the Website, frequently used information is automatically displayed for you. We are able to track your usage patterns with the help of the cookies. The information generated by cookies about the use of the Website is transmitted to a Google server, which may be located within or outside of, the United States, and stored there. Google will use this information to evaluate your use of the Website. Google may transfer these rights to third parties insofar as it is required to do so by law or in order that data may be processed on Google’s behalf. By accepting this Notice, you consent to the processing of your data by Google.

Additionally, we and our third-party service providers (such as advertising and analytics providers) use cookies, web beacons, clear GIF, pixels, internet tags, and other similar tracking technologies (collectively, “tracking technologies”) to gather information when you interact with our Website and email communications. Some tracking technologies help us maintain the security of our Website and your account, prevent crashes, fix bugs, save your preferences, and assist with basic site functions. We consider these tracking technologies to be necessary, because we need them for the Website to work properly. We don’t provide the option to opt-out of these tracking technologies, but you may be able to remove these tracking technologies by modifying your browser settings. Please note, some features of our Website may not be available to you as a result.

How We Use Your Information

As noted above, we permit third parties to use tracking technologies on our Website for analytics to understand how visitors interact with our Website. For example, we use Google Analytics to evaluate website traffic and usage data to help us improve our services. Disclosure of Your Information

We may disclose aggregated information about our users, and information that does not identify any individual or device, without restriction. In addition, we may disclose personal information that we collect or you provide:

  • To our affiliates, contractors, service providers, and other third parties we use to support our business operations;
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Lean Agile Intelligence’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Lean Agile Intelligence about our users is among the assets transferred;
  • To fulfill the purpose for which you provide it (such as transmitting emails, receipts, product updates, or other communications to the email address you provided to us for that express reason);
  • For any other purpose disclosed by us when you provide the information or with your consent;
  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request;
  • To enforce or apply this Privacy Notice, our Terms of Use, or
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of our company, our affiliates, users, or others.

Except as provided herein, personal information collected through the Website will not be sold or otherwise disclosed to third parties for direct marketing purposes.

We may disclose information about you if we determine that for national security, law enforcement, or other issues of public importance that disclosure of information is necessary.

Your Choices About Our Collection, Use, and Disclosure of Your Information

We strive to provide you with options regarding the personal information you provide to us. If you do not want us to collect your information, as described in this Notice, do not use the Website. This section describes mechanisms we provide for you to control certain uses and disclosures of your information.

  • Tracking Technologies. You can set your browser to refuse all or some cookies, or to alert you when cookies are being sent. To learn how you can manage your Flash cookie settings, visit the Flash player settings page on Adobe’s Website. If you disable or refuse cookies or Flash cookies or block the use of other tracking technologies, some parts of the Website may then be inaccessible or not function properly.
  • Email and Promotional Offers. When you contact us through certain forms on the Website or through email, you may be added to our email list to receive email messages. At any time, you can choose to no longer receive such emails by using the “unsubscribe” method found in each email or by sending us an email or other correspondence stating your request.
  • Contact us/Personal Information. If you have any questions regarding this Privacy Notice, have a specific request to access, correct, or delete any personal information that you have provided to us, or if you feel that the Website has not followed its Privacy Notice or Terms of Use, feel free to contact us, as provided below. Note that we may have to delete your user account on the Website, in order to delete your personal information. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.
  • If you delete your User Contributions from the Website, copies of your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other Website users. Proper access and use of information provided on the Website, including User Contributions, is governed by our Terms of Use.
No Collection of Information from Children

Our Website is not intended for children under 18 years of age. We do not solicit or knowingly collect any information from visitors under 13 years of age, and please do not use the Website if you are not yet 18. If we learn we have collected or received personal information from a child under 13, we will delete that information. If you believe we might have any information from or about a child under 13, please contact us immediately through the Contact Information section below.

“Do Not Track” Signals

Residents of certain states, including California and Delaware, may be subject to particular statutes requiring disclosure of how the Website responds to web browser “do not track” signals or other mechanisms that provide consumers the ability to exercise choice regarding the collection of personal information about their online activities over time and across third-party websites or online services, such as California Bus. & Prof. Code § 22575 and 6 Del.C. § 1205C. Although it is not clear that any such statute applies to our operation and your use of the Website, an example might be a browser option allowing you to ask websites not to track you across third-party websites so that they can serve targeted or behavioral advertising to you. You should not use the Website if you desire a “do not track” signal, because the Website may not honor it.

Additional Privacy Rights for California Residents

California residents may have additional rights under the California Consumer Privacy Act of 2018 (“CCPA”), subject to certain limitations. The obligations and rights in this section do not apply to personal information we collect from or about job applicants, vendors, suppliers, independent contractors, current or former full-time, part-time, and temporary employees and staff, officers, directors, or owners of Lean Agile Intelligence or residents of any state other than California. No user of the Website will be discriminated against for exercising their rights under the CCPA.

As described in this Notice, we collect the following categories of personal information from users of the Website to provide our services and related support, analyze, personalize, and improve our services, engage in advertising, marketing and promotional activities, process sales, execute our internal operations, secure and protect our business, and comply with legal obligations:

  • Name, contact information and other identifiers, including but not limited to email, IP, home, and business addresses, phone number, login credentials, personal and online identifiers, and IP address;
  • Age or date of birth;
  • Internet or other electronic network activity information, including but not limited to browsing history, search history, and information regarding a user’s interaction with the Website, other internet websites, or advertisements;
  • Geolocation data, including but not limited to city, state, and zip code; and
  • User preferences regarding the Website and our products.

Subject to certain exemptions, if you are a California resident, the CCPA grants you the following rights:

  • Request to Know. California residents have a right to request a copy of particular information we have collected about you, up to two (2) times in a 12-month period, subject to certain exemptions. We will deliver this information, free of charge, by mail or electronically in a portable and, to the extent technically feasible, readily usable format that allows the requester to transmit this information to another entity without hindrance, which may include:
    • categories of personal information collected;
    • types of sources from which the personal information is collected;
    • business and/or commercial purposes for collecting and selling a user’s personal information, and the
    • categories of third parties with whom we have shared personal information.
  • Request to Delete. California residents have a right to request that we delete any personal information about them that we have collected through the Website, subject to certain exceptions. If you are a California resident who makes such a request, once we receive and confirm your verifiable request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

    We may deny your deletion request if we collected the information as part of a business-to-business transaction or if retaining the information is necessary for us or our service provider(s) to do any of the following:
    • Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with you.
    • Detect, prevent, or mitigate security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
    • Use the information as necessary to identify and repair errors that impair existing intended functionality.
    • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
    • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
    • Enable solely internal uses that are reasonably aligned with our normal operations and consumer expectations based on your relationship with us.
    • Comply with a legal obligation.
    • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Only you, or someone legally authorized to act on your behalf, may make one of the above requests related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

In order for us to act on one of these requests, we must be able to verify your identity or authority to make the request and confirm the personal information relates to you, and your request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request and will not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

  • Right to Opt-out of Sale of Personal Information. The CCPA gives California residents 16 years of age or older the right to opt-out of the sale of their personal information at any time. This Website is not intended for use by children, so we do not sell the personal information of consumers we know are less than 16 years of age, unless we receive affirmative authorization (the “right to opt-in”) from either the consumer who is at least 13 but not yet 16 years of age, or the parent or guardian of a consumer less than 13 years of age. Consumers who opt-in to personal information sales may opt-out of future sales at any time.

If you are a California resident and would like to make any request as described herein, please contact us as provided in this Notice. We will respond to verifiable requests received from California residents as required by law.

Using the Website from Outside the United States

Our primary servers are located in the United States of America. If you are accessing the Website from outside the United States of America, please be aware that your information may be transferred to, stored, and processed by us in our facilities and by those third parties with whom we may share your personal information as described in this Privacy Notice, in the United States of America and other countries.

If you are a resident in the European Economic Area, then these countries may not have data protection or other laws as comprehensive as those in your country. We will however take all necessary measures to protect your personal information in accordance with this Privacy Notice and applicable law.

Data Processing Agreement

Such measures implement the European Commission's Standard Contractual Clauses for transfers of personal information between our group companies and between us and our third-party providers, which require all such recipients to protect personal information that they process from the European Economic Area in accordance with European data protection laws. Our Standard Data Processing Agreement can be provided upon request. We have implemented similar appropriate safeguards with our third-party service providers and partners and further details can be provided upon request.

Data Privacy Framework Policy

Lean Agile Intelligence is committed to respecting and protecting the privacy of all personal data collected and/or processed through the Website. Lean Agile Intelligence acts in accordance with the EU-U.S. Data Privacy Framework (DPF), the UK extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information from the European Economic Area, the United Kingdom, and Switzerland transferred to the Unites States pursuant to the Data Privacy Framework. We have certified that we adhere to the DPF Principles with respect to such data. Lean Agile Intelligence is subject to the investigatory and enforcement powers of the Federal Trade Commission of the United States of America.

In the context of any onward transfer of personal data, Lean Agile Intelligence remains responsible for all onward transfers of personal data from the EU, UK, and Switzerland to third parties who process personal data in a manner inconsistent with the DPF, unless Lean Agile Intelligence can provide that we are not responsible for the event giving rise to the damage.

Collected Personal Information

We strive to collect only the minimal amount of personal data.

Some, none, or all of the individuals for whom we have received personal data may be located in the European Economic Area. Accordingly, we treat all personal data as if they were in the European Economic Area for data privacy purposes.

Due to the nature of our service, we may receive some of your personal data from any institution, organization, coach, or consultant that requests our services on your behalf. If you participate in one of our assessments, depending upon the assessment configuration, we may also ask for and collect your personal data and assessment responses.

Depending upon assessment configuration and you use of the Website, we may receive or collect some, or all, of the following personal data: email address, display name, team role, assessment responses, assessment notes, business details, and other information when you contact us. Work completed before, during, or after correspondence including, but not limited to, personal correspondence, videos, and images.

We limit additional data to only that which is necessary for your respective type of service.

  1. Visitors to the Website: When you visit the public part of the Website, we do not record your personal data. When you visit some section(s) of the Website, you may be prompted for personal data to access or complete a purchase of our services by a third-party integration. You will control personal data shared and your storage preferences directly with our third-party providers.
  2. Users registered on the Website: In order to participate in our services and for us to manage privacy preferences, users (registered members, participants) must be recognizable via a registered account. The following basic information is required to register an account: email address, display name, and the inviting organization if not registered by yourself. If registering a new organization, the organization display name, industry, transformation journey length, country, and number of employees are required. All account holders have control over their personal data stored in "Account" on the Website or by contacting us via email.
  3. Assessment participants: Participants receive an invitation from their organization to participate in an assessment. Upon joining, depending upon the assessment configuration that your assessment facilitator set, we may ask you for your email, display name, and team role. We collect and store this personal data in addition to assessment response(s) in order to report to your organization the identity of the participants.
  4. Users who contact us: We may collect your first name, last name, email address, company name, and phone number to investigate and contact you concerning your request.
  5. Users who opt to receive marketing communication: We may collect your email address, display name, organization display name, or other contact information to respect and return information based on your communication preferences.
Using your personal data

Under GDPR, we must always have a lawful basis for using personal data. This may be because the data is necessary for our performance of a contract with you, because you have consented to our use of your personal data, or because it is in our legitimate business interests to use it. Under these conditions, your personal data may be used for the following purposes:

  • Providing and managing your account and your access to the Website
  • Entering a contract and supplying our services to you
  • Personalizing and tailoring your experience on the Website
  • Notifying you of changes and additions to the Website that may affect your account
  • Communicating with you, including responding to emails or calls from you
  • Supplying you with information by email that you have opted-in to and can unsubscribe / opt-out at any time
  • Analyzing your use of the Website and gathering feedback to enable us to continually improve the Website performance and your experience
  • Contacting you (around the scheduled expiry of your personal data) for your decision to anonymize or personally extend our services and available options for continuing access to your personal data and account

We never sell your personal data nor will we send you any unlawful marketing or spam.

Your data rights

Privacy laws around the world, including the European General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA), provide users with rights related to their personal information. To demonstrate our commitment and compliance with those laws, European Economic Area residents have the following data protection rights with respect to their personal information:

  • Right to access - You have the right to request copies of your personal data.
  • Right to rectification - You have the right to request that we correct any information you believe is inaccurate. You also have the right to request us to complete the information you believe is incomplete.
  • Right to erasure - You have the right to request that we erase your personal data, under certain conditions.
  • Right to restrict processing - You have the right to request that we restrict the processing of your personal data, under certain conditions.
  • Right to object to processing - You have the right to object to our processing of your personal data, under certain conditions.
  • Right to data portability - You have the right to request that we transfer the data that we have collected to another organization, or directly to you, under certain conditions.
Where you have provided consent, you may withdraw it at any time. When you withdraw consent, you acknowledge and accept that this may have a negative influence on the quality of our service or even make features and services unavailable.

We will always work to fully protect your rights and comply with our obligations under GDPR and the DPF. We will always give you the opportunity to opt-out of marketing communications, opt-out of performance cookies, and opt-out of select third-party integrations to limit the use and disclosure of your personal data.

Complaints

In compliance with the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF, Lean Agile Intelligence commits to cooperate and comply respectively with the advice of the panel established by the EU data protection authorities (DPAs) and the UK Information Commissioner’s Office (ICO) and the Swiss Federal Data Protection and Information Commissioner (FDPIC) with regard to unresolved complaints concerning our handling of personal data received in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF.

If your DPF complaint cannot be resolved through the above channels, under certain conditions, you may invoke binding arbitration for some residual claims not resolved by other recourse mechanisms.

Data Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure, but ultimately the safety and security of your information depends on you. We urge you to be careful about giving out information in any public areas of the Website. The information you share in public areas may be viewed by any user of the Website.

Unfortunately, the transmission of information via the internet is never completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted through our Website. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website.
